To book your photo session, you need to agree to the terms and conditions by paying a booking fee. Please read the terms and conditions below and check the box at the end of the page to confirm your booking.
Terms of Service Steph V Photographer 2024
The following terms and conditions establish the understanding between ‘Steph V Photography,’ hereinafter referred to as “the Photographer,” and the individuals responsible for arranging the photography services, hereinafter referred to as “the Client.”
These terms constitute the complete agreement between both parties, and any changes or adjustments to these terms will be considered valid only if agreed upon in writing by both parties.
Payment of the deposit and/or continued communication via email signifies the Client’s acceptance of these Terms of Service for the photoshoot at the location, date, and time previously agreed upon via email.
Copyright Statement:
The client understands they are obtaining a license, not the outright ownership, of the Image(s) based on the terms in this agreement. Acquiring the full copyright would involve a higher cost than the licensing fee.
In accordance with Japanese Copyright Laws, the Photographer will retain copyright and grant the Client use rights.
The client must not alter or remove copyright metadata without explicit consent.
Unless specified otherwise, the photographer retains the right to use the Image(s) for self-promotion.
Under no circumstances may the client alter, edit, or change the images, including through photo editing applications or filters like Instagram.
Booking and Payment
To confirm the reservation of a photoshoot and secure the services, the Client is required to remit a non-refundable retainer to the Photographer.
This retainer serves to reserve the specified date and time exclusively for the Client’s photoshoot, precluding the Photographer from reserving the same timeframe for another client. It is imperative to acknowledge that the retainer is non-refundable under any circumstances, encompassing costs associated with the preexisting planning and coordination of the photoshoot.
The balance of the total fee is due in cash on the scheduled date of the photoshoot, with the sole acceptable currency being Japanese Yen.
Punctuality Agreement
Both the Client and the Photographer acknowledge the significance of cooperation and punctuality in achieving the mutually agreed-upon goals and preferences. The photoshoot is set to commence at the designated start time and conclude at the scheduled end time.
In the event of tardiness on the part of the Client, the delayed time will be deducted from the overall shooting duration. Consequently, the Client will be obligated to remit the previously agreed-upon fee, taking into account the reduction in shooting time caused by the delay.
Cancellation Policy
1. If the client wishes to cancel the booking, the deposit is non-refundable.
2. For cancellations made within 10 days of the scheduled session, the client will incur a charge of 50% of the agreed fee.
3. No-shows will result in a charge of 80% of the agreed fee.
4. Any request for postponement, date change, or amendments to agreed sessions is subject to availability. Changes to agreed sessions will be subject to the most current rate schedule.
5. If the photographer is unable to accommodate the client’s request, the deposit will not be refunded.
6. During peak season, if the client requests a postponement within 2 weeks, the deposit may be forfeited.
7. If there is heavy rain, the photographer will make an effort to reschedule the session, taking into consideration the availability of both parties. Nevertheless, cancellations will not be accommodated solely because the weather does not meet the client’s preferences.
Other expenses
The Client shall bear all applicable travel, accommodation, meal, and transportation expenses incurred during the session, unless otherwise specified by prior arrangement. Such arrangements may be agreed upon through email communication before the session.
Please be aware that in cases where the chosen location, such as parks, gardens, or other venues, imposes an entrance fee, the Client is responsible for covering both their own entrance fee and that of the photographer.
Weather conditions
As an outdoor photographer we need to work with different weather conditions. We have our ideal weather, but is also important to know that the show must go on, even if we get a light rain in the forecast. Only if the weather forecast announces heavy rain and thunderstorms, I’ll suggest to move the date. I’ll make the decision 24 h prior to the scheduled photo session.
Limit of Liability
In the unlikely event that the Photographer cannot fulfill the terms of this contract due to circumstances like injury, illness, or other uncontrollable factors, reasonable efforts will be made to secure a suitable replacement. If a replacement is unattainable, the Photographer’s responsibility is limited to refunding all payments received for the Event.
In the rare circumstance that digital files are lost, stolen, or destroyed due to factors beyond the Photographer’s control, including incidents like camera, hard drive, or equipment malfunction, the Photographer’s liability is confined to refunding all payments, including the deposit, received for the Event.
By engaging in a photography session with the Photographer, the Client releases the Photographer and associated entities from any and all liability. This release covers events like death, disability, personal injury, property damage, property theft, or any actions during travel to and from the Event. The Photographer is not responsible for injuries sustained by any participants.
The Photographer is not liable for loss, damage, or alteration to the client’s clothing and personal items. Clients must acknowledge that certain photos may result in dirtiness. The client is solely responsible for ensuring their clothing, makeup, hair, and overall appearance meet their desired standards for the photos.
The Photographer’s role is limited to directing and capturing images of the client. The Photographer is not liable for issues related to style, makeup, hair, or other factors beyond their direct involvement in the photography process.
Photoshoot and Gallery Delivery
The number of images that will be delivered is in line with the session length. The Photographer is not required to provide every photo taken.
Photo processing
The Photographer holds creative responsibility for capturing images during the shoot. However, the Photographer will consider the Client’s reasonable instructions outlined in the shoot brief. Upon completing the shoot, the Photographer will provide the Client with final processed images in the Steph V editing style and overall look, in high resolution, through a secure online gallery.
This delivery will occur within a timeframe of 5 to 15 business days, with no guarantee of an urgent turnaround. It’s important to note that major photoshop editing is not covered under this agreement. The Client is aware that the Photographer does not maintain archives of images after delivery.
Photography Consent Agreement
This document functions as a model release, bestowing upon the Photographer the authorization to utilize images for promotional purposes on social media, portfolio, and other legal channels. The Client relinquishes any entitlement to profits arising from the image’s utilization.
The Photographer and Client are prohibited from selling images to third-party agencies unless expressly permitted through a mutually agreed-upon and signed waiver.
